The Shanghai IP court recently issued judgements in favor of Volvo in a number of design patent and trademark infringement suits against a local infringer. Besides the injunction order, the court awarded Volvo damages of around RMB 2 million and recovery of legal fees of RMB 400,000.

In this case, LexField worked closely with Volvo’s international law firm to develop a solid investigation and litigation strategy.  Eventually, Volvo’s arguments persuaded the court and it won 11 of the 7 patent and 4 trademark infringement suits.

This case is an indication of Volvo’s determination to safeguard its legitimate rights through legal actions when it becomes necessary. It is also a good example of the steady efforts made by China’s judiciary, particularly the Shanghai Intellectual Property Court, to protect intellectual property rights and maintain a fair market for both domestic and foreign companies doing business in China.
